Swole vs Wal Mart

Earlier this year, I took my wifes car in for an oil change. We drove the car up to the tech and he took our order. I opened the driver's door, got out and he scanned a bar code on the door jam. I signed the little machine and i was off to shop. When we came back to the car I tried to opened the door to get in and couldn't open it all the way! I looked at the door and there was a dent preventing me from opening the door! I called the tech and he told me it was like that! I was instantly angered at the comment. I replied "you were the one that took my order with with the door open. You scanned my barcode and i signed your machine. The door won't open now! what happened?" He replied "It was like that." I asked him if the reply that he gave me was not contradicting the action he took to scan the bar code. Apparently i was too intelligent for him and considered the question beyond his intellect and replied "I don't know man, it was like that" He then got the manager and he said that he would report it to their insurance. After 10 days the insurance agent called and said that they were not liable for the damage because the cameras did not show any negligence. So I decided to file a law suit. I had just bought that car for my wife not a week before and was not going to let them get away with that.

The estimates came out to like $1300. So being the honest person that I am I sued for $1400 for fuel and and time plus court costs which I had to file twice because It was damn near impossible to find out the actual correct name to serve papers to. So we go to the pre-trial and I asked for these tapes that they were talking about showing no negligence. I got the video 2 days ago and upon reviewing the video, I see that they completely left out when the order was being taken which is when the door was completely open and showed there was no trouble. But, it did show the tech getting in the car and driving the vehicle in the garage with the door open. It also shows when they noticed the damage. Now I have to take into consideration whenever I get the vehicle fixed the time it's going to take and the wifey being without a car. I don't know if I am going to be able to add to the damages done but it is worth a try. The whole thing is a mess! I was just shocked at the whole idea that they figured was just going to accept the tech's reply of it being like that when it was clearly fresh damage! :cursing: I hate it when bad things happen to good people! Well we will see what happens. Normally I wouldn't go as far as to sue anyone but this was just out of control!

That is crazy. I haven't had anything to this extent but I did have the Lube dept strip my oil pan drain threads by using a pneumatic wrench instead of a socket wrench. Then try and say it was like that. I have been changing my own oil every sense.

I've never had problems with Wal-mart like that, but I know they get a lot of fraud comliants. A friend of mine's husband used to work alongside the Wal-mart insurance investigators and he said he'd seen claims against Wal-mart such as a woman watching her kid empty milk on the floor, then walking directly through it. So I can kind of see how they could be a bit skeptical, but this sounds more like the investigator just didn't watch the video to begin with. Or, because of the number of claims, it might be standard practice to deny them at first. Whichever, it doesn't sound like very ethical practices on Wal-mart's part.

Wow...I knew someone that got their oil changed at E-Z Lube and they forgot to tighten the oil filter and two days later it fell off, drained all the oil and seized the motor. He took pictures called E-Z Lube and they replaced the motor no questions asked...The only problem he had was they wanted to give him a used motor with more miles than the other one, but after some discussion they gave him a used motor with less miles than the original and had a factory dealer put it in.

I do not care for Wal-Mart much anymore and might shop there once a month, for small stuff only as well. This is reason more not to shop there. they have killed the true meaning of Customer Service, but they will get you cheap prices. Myself, I will pay for good service.
